Terms of Service
These terms are an agreement between you and Infonex (“we”, “us”) for using Fuby at fuby.ai. By signing up or adding a Fuby helper to a website, you agree to them.
1. What Fuby is
Fuby lets you set up a voice helper, teach it about your business, and add it to your website with one line of code. Visitors tap the helper and talk to it. It answers from what you taught it and can show buttons to pages you choose. You can see every conversation, with transcript and recording, in your dashboard.
2. Your account
- You sign in with Google. You must be at least 18 and able to make this agreement for yourself or your business.
- Keep your Google account secure. You are responsible for what happens in your Fuby account.
- Give us accurate details and keep them up to date.
3. Plans, payment and talk time
- You can set up and test a helper for free. To use a helper on your website you need a monthly talk-time plan. Prices are shown in Australian dollars before you pay.
- Plans renew automatically each month and are charged to your card through Stripe until you cancel. Minutes reset each billing period, and unused minutes don’t roll over.
- When your minutes run out, your helpers stop taking new calls until the next period or until you upgrade. Each call is capped at 5 minutes.
- You can change or cancel your plan any time from the dashboard. Cancelling stops renewal and your plan stays active until the end of the period you’ve paid for. Plan changes are prorated.
- Fees are non-refundable except where the law requires otherwise. Nothing in these terms limits your rights under the Australian Consumer Law.
- We may change prices with at least 30 days’ notice. The change applies from your next billing period.
4. Your responsibilities for recording visitors
Fuby records calls with your visitors and shows you the audio and transcript. You are responsible for using it lawfully. In particular, you must:
- Tell visitors that chats are recorded and how you use them, for example in your own privacy policy. The helper always says “This chat is recorded” before it starts, and you must not hide or change that notice.
- Follow the privacy, surveillance and call-recording laws that apply to you and your visitors. These include the Privacy Act 1988 (Cth), state and territory surveillance device laws, and overseas laws such as GDPR if you have visitors there.
- Respond to visitors who ask to access or delete their recordings. You can delete conversations by deleting a helper, or ask us for help.
- Only use recordings and transcripts for legitimate business purposes, and keep them secure.
For visitor recordings and transcripts, you decide how they’re used and we process them for you, as described in our Privacy Policy.
5. What your helper says
- Your helper uses AI to answer from the information you give it. AI can make mistakes. It may misunderstand a visitor or give an incomplete or wrong answer, even though it’s told not to invent facts.
- You’re responsible for the information you teach it and for checking that it’s accurate and up to date. Don’t rely on it for advice where an error could cause harm, such as medical, legal, financial or emergency advice.
- Your helper is not a substitute for being able to contact you. Make sure visitors can reach a real person.
6. Acceptable use
You must not use Fuby to:
- break the law, or mislead visitors about who they are talking to or what you offer;
- collect sensitive information (such as health, financial or identity documents) or information from children through the helper;
- harass, threaten, discriminate against or impersonate anyone;
- teach the helper content that is unlawful, hateful, sexual or that you don’t have rights to;
- interfere with the service, get around talk-time limits or security, scrape it, or use the voice service outside the Fuby widget;
- break the usage policies of our AI provider, OpenAI.
We may suspend or remove a helper or account that breaks these rules. Where it’s reasonable, we’ll tell you first and give you a chance to fix it.
7. Your content
You own what you teach your helper and your conversation data. You give us permission to store and process it only to run Fuby for you. We don’t use it to train AI models. When you delete a helper or close your account, we delete its data as described in the Privacy Policy.
8. Our service
- Fuby, its software, characters (Fuby, Mochi, Tobi, Pipo, Kiko and Bibo) and brand belong to Infonex. We give you a non-exclusive right to use them on your website while your account is active.
- We work hard to keep Fuby running, but we can’t promise it will always be available or error-free. It depends on third-party services such as OpenAI, Supabase, Vercel and Stripe.
- We may improve or change features. If a change significantly reduces what you’ve paid for, you can cancel and we’ll refund the unused part.
9. Liability
To the extent the law allows, Fuby is provided “as is”. We are not liable for indirect or consequential loss, lost profits, or loss caused by what your helper says to visitors. Our total liability to you is limited to the fees you paid us in the 3 months before the claim.
Some rights under the Australian Consumer Law can’t be excluded. Where our liability for failing to meet a consumer guarantee can be limited, it is limited to supplying the service again or paying for it to be supplied again.
You agree to cover our reasonable costs if a third party makes a claim against us because of how you used Fuby, including how you recorded or used visitor conversations.
10. Ending this agreement
You can stop using Fuby and cancel at any time. We may end this agreement with 30 days’ notice, or straight away if you seriously break these terms. When it ends, your helpers stop working and we delete your data as described in the Privacy Policy.
11. Changes to these terms
We may update these terms. If a change is important, we’ll tell you at least 14 days before it applies. If you keep using Fuby after that, the new terms apply.
12. General
These terms are governed by the laws of New South Wales, Australia, and the courts of New South Wales have jurisdiction. If part of these terms can’t be enforced, the rest still applies.
